Copyright Issues |
All material on this site (except as noted on the individual pages) is created and copyright by Pam Green. While I give anyone permission to use and distribute my material for purposes of promoting dog welfare, there are some limitations on this use. This permission to use my material does NOT imply that I am abandoning my copyright or placing the work in the public domain.
The first limitation is that you must include my authorship and my copyright notice, and you may NOT ALTER the content in any way. It's OK to re-format the font, text size, margins, and so on , and you may feel free to correct any spelling or typo mistakes I have left behind; but DON'T alter anything I have said and DON'T take anything out of context.
Those of you who might want to use my work as an inspiration for something similar related to another breed, that is OK and obviously you would then be modifying the material to make it fit your breed. For such modified material , you would NOT list me as the author, but you might do me the courtesy of including a line on the order of "inspired by ....(name of article)...... written by Pam Green."
The second limitation is that you may NOT SELL any of my material UNLESS you are donating the proceeds to a dog Rescue group or to fund your own private Rescue efforts . Breeders , you are welcome to include my material in your puppy information packages. Rescuers, you are encouraged to include my material in your adopter information packages. Shelters, you are also permitted and encouraged to copy and distribute any of my work that you feel will help save lives and promote good adoptions.
WARNING : some of this material is DERIVATIVE from material that is copyright by someone else. Use of derivative material can be a violation of the copyright of the original material's author. Laws as to length of copyright vary between countries and have changed over time in some ways that can get rather complicated. (For more details see "The Copyright Handbook" from Nolo Press or "The Public Domain" from Nolo Press. copyright and other intellectual property law gets very complex.)
My text articles are all original with me so don't pose any derivative work issues. Most of my photographs were taken by me, except obviously for the ones in which I appear in the photo. All of my non-cartoon artwork is original with me.
Some of my material which is derivative would be most of the songs and poetry and most of the cartoons. I certainly hope anyone who feels I have infringed their copyright by using their work as an inspiration for mine will forgive me. I'm just having a little fun and trying to help dogs by educating their people, and I certainly have never made a penny off of any of this. Also, now that I have studied the wonderful Nolo Press book "The Public Domain", I am reasonably sure that all of my derivative material would qualify under the "Fair Use" priviledge sub-genre "Parody" as (1) the intent is at least partly to comment upon the original work and to have some humorous fun with it, (2) my work does not take more of the original material than necessary for the purpose, and (3) my work neigther fulfils the market demand for the original nor competes with it. (Actually since I generally parody only work that I greatly admire, I'd like to think that if my work had any effect on the market for the original, that effect would be to increase the demand for the original.) My copyright for derivative works extends only to the portion of the resulting work that is new, not the portion that was in the underlying original work. Some of the songs and verse are based on very old work which is now in public domain, so for these works there is no problem.
In addition to my copyright for the content of my original works, and for the new portions of derivative works, I also claim collective works copyright for the selection and arrangement of the individual items in this site and copyright for the overall design elements and the look and feel of the site and for my commentary accompanying individual items.
Guest Author material : As for material that is identified as being written by someone else, please remember that the copyright belongs to the original author. Except for those few pages where the original author has said that widespread distribution is permitted, these pages can NOT be further distributed without express permission from the original author. Pages with guest material are color coded in the title box , just as this notice is color coded, a sort of pastel peach color rather than the lavender (pale blue on some monitors) of the rest of the site. (If you are on a greyscale monitor you won't be able to discern an obvious difference.) In the case of Guest material, the copyright for the original material remains with the author. My own copyright is only for any added commentary of mine plus the "collective works" copyright for selection and arrangement of material and the copyright pertaining to the overall look and feel of the site and the elements that create that look and feel. |
